(Belleville, IL) — An Indiana man is set to appear in a Metro East court in connection to a decades-old case of an infant’s murder after the Illinois Supreme Court refused to hear an appeal of having a trial. Gary Warwick of Portage was originally charged with the murder of one-year-old Joseph Abernathy the Third, of Belleville, back in 1973, but the charges were dropped. The case was re-opened in 2013, and Warwick was charged, but the case has been in legal limbo since. Warwick is scheduled for an appearance in St. Clair County Court on December 20th.
