Brett Herbert had been held in the Marion County Jail with bail set at $250,000 since his March arrest on two Class 1 felony charges of criminal sexual assault of a family member under the age of 18.

According to Central City police, a warrant had been issued for Herbert’s arrest that stemmed from an investigation that was launched when the victim’s mother filed a report with police and the child was interviewed by the Amy Center.

On Wednesday the court dismissed the two Class 1 sexual assault charges against Herbert per the plea agreement, and he instead pleaded guilty to a lesser charge of Class 2 felony aggravated criminal sexual abuse.

Herbert was subsequently sentenced to 4-years intensive sex offender probation, and ordered him to pay court costs. The case is scheduled for a November review.
