FAYETTE COUNTY — A 53-year-old Farina man is seeking to withdraw his guilty plea in a child sexual assault case that resulted in a nearly 12-year prison sentence in a Fayette County court case.

Larry Sapp pleaded guilty in June of 2017 to predatory criminal sexual assault of a person under age 13 in exchange for an 11 ½ year prison sentence.

Sapp is now claiming in a letter to Judge Donald Sheafor that Public Defender William Starnes would not let the case go to trial and contains allegations against Fayette County State’s Attorney Josh Morrison and State Police Special Agent Jeff Kline.

During a court hearing in the case this week the case was referred to the Appellate Prosecutor’s office for referral to the Attorney General’s office. The AG’s office has not yet been contacted.

The court must now determine whether Sapp’s letter to the judge should be considered a post-conviction motion. A pre-trial hearing in the matter is set for 10 a.m. on January 22.
