FAYETTE COUNTY — A Fayette County judge found a 59-year-old Herrick man guilty at A bench trial Wednesday in Fayette County court of all charges of sexual assault of a child.

Roger Seaton was arrested in the case in February 2017, on three Class X felony charges of predatory criminal sexual assault of a victim under the age of 13.

His bail was set at $150,000 and a few days after his arrest he posted $15,000 cash bond and was released, with special conditions of having no contact with the victim or her mother.

Court records say Seaton committed three separate acts of sexual penetration on the female victim.

Multiple jury trial dates had been vacated in the case before the defense decided to have the case tried by a judge rather than a jury.

On Wednesday, Resident Judge Don Sheafor heard arguments from both the defense and prosecution, as well as testimony from the defendant before handing down a verdict of guilty on all three counts.

A pre-sentencing report was ordered to be completed by probation services and a sentencing hearing was set for April 9. Seaton could face between 6 and 60 years in prison on each count.

He was taken back into custody following the verdict and will remain in the Fayette County Jail without bond until he’s sentenced.
