CLINTON COUNTY — A 31-year-old Missouri man was sentenced Tuesday to 10 years in prison after he pleaded guilty in Clinton County Court to a 2009 incident for which he had already been imprisoned.

The 2009 charges against Jamil Jaber were dismissed Tuesday in exchange for his guilty plea to the Class X felony kidnapping charge filed in November 2017.

Jaber’s 2009 case had been remanded back to Clinton County Court after his guilty plea in the sexual assault case was withdrawn.

He was then released in September 2017 on $25,000 cash bond and had remained free until being taken back into custody on Tuesday.

Jaber was charged in February 2009, with Class 1 felony criminal sexual assault and Class X felony aggravated criminal sexual assault resulting in bodily harm.

He pleaded guilty in December 2009 to the Class X charge in exchange for the Class 1 charge being dismissed and was subsequently sentenced to 15 years in the Illinois Department of Corrections.

In August 2012, Jaber unsuccessfully attempted to withdraw his guilty plea, and then filed a motion for a reduction in sentence.

The defense claimed the court should not have considered hearsay evidence in deciding the 15-year prison sentence, calling it excessive.

The courts acknowledged that if it was not supposed to consider prior similar acts at the sentencing, Jaber would have received a lighter sentence. The defense then filed a notice of appeal.
