FAYETTE COUNTY — A 32-year-old Vandalia man is scheduled to be sentenced Tuesday in Fayette County court on a Class 2 felony charge of sexually abusing a minor.

In August, Ernest K. Klucas Jr., filed an open plea of guilty to one of four Class 2 charges of Class 2 felony aggravated criminal sexual abuse of a minor.

An open plea does not come with an agreed upon sentence and is not an actual plea of guilt. In such a plea, the defendant is only agreeing that if the case were to go to trial the prosecution had sufficient evident to likely get a conviction.

In the agreement Klucas entered, three of the four counts against him were dismissed in exchange for his open plea on one count.

A pre-sentencing investigation and Phychosexual Risk Assessment/Evaluation of Klucas was filed in court last week.

He has remained in the Fayette County Jail since his August 2017 arrest by Vandalia police after a warrant on the charges had been issued.
