FAYETTE COUNTY — A 24-year-old Vandalia woman filed an open guilty plea this morning in Fayette County Court to throwing her infant son to the floor last February causing the child permanent disability.

Aubree Hammer pleaded to a Class X felony charge of aggravated battery to a child under the age of 13 causing great bodily harm of permanent disability.

Unlike most plea agreements, an open plea of guilty does not come with an agreed upon sentence. Hammer will be sentenced following the completion of a pre-sentencing investigation. A Class X felony is punishable by between 6 and 30 years in prison.

Court records say Hammer held her 3 ½ month-old son head high and threw him to a wood floor causing the baby brain damage.

Hammer is scheduled to be sentenced November 15. She remains in the Fayette County Jail.
