(VANDALIA, IL) — Sentencing has been delayed for a 57-year-old Vandalia man convicted in Fayette County court on felony child pornography charges after disagreements arose between the defendant and his private attorney. William Frakes was scheduled to be sentenced Thursday on two Class X felony counts of possessing child pornography depicting a child under the age of 13 in a sadistic manner and Class 2 felony possession of child pornography depicting a child under the age of 13. However, Frakes indicated in court Thursday that he would be retaining new counsel and requested sentencing be continued. The court accepted defense attorney Robert Bas’s motion to withdraw from the case and against the objection of the state sentencing was delayed. Following the return of the jury’s guilty verdict in February, Frakes was remanded back to the Fayette County Jail without bond. A court ordered pre-sentencing report has been completed and the court has received a letter from the defendant. The case is next scheduled for an April 28 hearing for status on Frakes’ new attorney. Frakes has no significant criminal history prior to his 2016 arrest on the child pornography charges. A Class X conviction is punishable by between 6 and 30 years in prison while a Class 2 is punishable by between 3 and 7 years.
