(MT. VERNON, IL) — The defense argued in Jefferson County court Tuesday against allowing a recorded interview with an alleged victim to be played at the trial of a 28-year-old Opdyke man charged with multiple child sex offenses. Judge Barry Vaughan heard arguments Tuesday in the case against Garrett McElveen. Prosecutors called the video interview with the alleged child victim and the Amy Center reliable evidence and argued that it should be played for the jury during trial. Prosecutors said that when interviewed in 2015 by the Amy Center, the child described several incidents of abuse by McElveen and that the recording should be entered as an exception to the hearsay rule. The defense objected to the video being viewed by the jury, saying that because the child will testify in court, the recording is unnecessary.  Public Defender Scott Quinn argued that because the interview was given during a frightening time for the child the accuracy of the statements given could have been affected. Judge Vaughan advised he would view the recording and then issue a ruling on its admissibility. McElveen was indicted in January 2016 on 11 Class X felony counts of predatory criminal sexual assault of a child and on Class 4 felony count of sexual exploitation of a child. The case is due back in court April 28, for a pre-trial hearing and a July 11, jury trial. McElveen remains in the Jefferson County jail with bail set at $300,000.
