(NASHVILLE, IL) — Prosecutors have elected to not pursue charges against a 45-year-old Nashville man who was charged earlier this month with sexually assaulting a woman with the use of a controlled substance. Dennis L. Johnston was formally charged in Washington County Court with Class X felony aggravated criminal sexual assault by drugging the victim with controlled substances. However, the woman informed the state Thursday that she did not wish to pursue charges against Johnston and the prosecution filed a motion for nolle prose, which could allow the case to be brought up again at a later date. Johnston was arrested earlier this month after an initial investigation by the Nashville Police Department indicated Johnston allegedly forced the woman to ingest a controlled substance against her will and then perform a sex act on him. A warrant was issued for Johnston’s arrest with bail set at $100,000. He had pleaded not guilty to the charge and was appointed a public defender. Johnston was released from the Washington County Jail after the prosecution’s motion was granted Thursday.
