(Springfield, IL) — A judge in Sangamon County is being asked if it’s legal for circuit court judges seeking to stay on the bench to take a different path to get there than retention. At issue is a move by three judges in St. Clair County who resigned, then filed to run in the Democratic primary for the seats they were leaving, thus avoiding the need to win a 60-percent majority in a retention election. The Belleville city clerk is bringing the case asking that these judges be removed from the ballot because their maneuver violates the state constitution.
